NAWL submits a brief to ban parental alienation accusations in family court

The National Association of Women and the Law (NAWL) has submitted a brief to the Standing Committee on the Status of Women for its study on Coercive Behaviour.

In its brief, NAWL calls on the government to legislate to ban parental alienation accusations in family court.

This demand echoes a recommendation of the UN’s Special Rapporteur on Violence against Women and Girls, its Causes and Consequences. In a report published in 2023, she called on all states to “legislate to prohibit the use of parental alienation or related pseudo-concepts in family law cases and the use of so-called experts in parental alienation and related pseudo-concepts”.

In its brief, NAWL stresses that victims of domestic violence are particularly at risk of being accused of “parental alienation” when they raise safety concerns. “Parental alienation” accusations can lead to children being placed with their violent father.
