{"id":18375,"date":"2024-05-08T08:32:35","date_gmt":"2024-05-08T12:32:35","guid":{"rendered":"https:\/\/nawl.ca\/?p=18375"},"modified":"2025-09-10T17:02:12","modified_gmt":"2025-09-10T21:02:12","slug":"memoire-comportement-coercitif","status":"publish","type":"post","link":"https:\/\/nawl.ca\/fr\/memoire-comportement-coercitif\/","title":{"rendered":"L&rsquo;ANFD soumet un m\u00e9moire pour interdire les accusations d\u2019ali\u00e9nation parentale devant les tribunaux de la famille"},"content":{"rendered":"<p><span data-contrast=\"auto\">L\u2019Association nationale Femmes et Droit a soumis un m\u00e9moire <\/span>au Comit\u00e9 permanent de la condition f\u00e9minine de la Chambre des Communes dans le cadre de ses travaux sur le comportement coercitif.<\/p>\n<p><strong>Dans son m\u00e9moire, l&rsquo;ANFD appelle le gouvernement canadien \u00e0 adopter une loi pour interdire les accusations d&rsquo;\u00ab ali\u00e9nation parentale \u00bb devant les tribunaux de la famille.<\/strong><\/p>\n<p>Cette demande fait suite \u00e0 une recommendation de la Rapporteuse sp\u00e9ciale des Nations unies sur la violence contre les femmes et les filles, ses causes et ses cons\u00e9quences. <a href=\"https:\/\/www.ohchr.org\/fr\/documents\/thematic-reports\/ahrc5336-custody-violence-against-women-and-violence-against-children\">Dans un rapport publi\u00e9 en 2023<\/a>, celle-ci a appel\u00e9 \u00e0 ce que tous les \u00c9tats \u00ab l\u00e9gif\u00e8rent pour interdire l\u2019invocation de l\u2019ali\u00e9nation parentale ou de pseudo-concepts du m\u00eame type dans des affaires relevant du droit de la famille, et le recours \u00e0 de pr\u00e9tendus experts en ali\u00e9nation parentale ou autres pseudo-concepts du m\u00eame type \u00bb.<\/p>\n<p>Dans son m\u00e9moire, l&rsquo;ANFD alerte sur le fait que les victimes de violence conjugale sont particuli\u00e8rement expos\u00e9es au risque de se voir accuser d\u2019\u00ab ali\u00e9nation parentale \u00bb lorsqu\u2019elles font part de pr\u00e9occupations en mati\u00e8re de s\u00e9curit\u00e9.
