Une interdiction de publication est une ordonnance du tribunal qui, dans le cadre d\u2019un proc\u00e8s p\u00e9nal, interdit \u00e0 toute personne de r\u00e9v\u00e9ler l\u2019identit\u00e9 d\u2019une victime, d\u2019un\u00b7e t\u00e9moin, ou d\u2019un\u00b7e autre participant\u00b7e du syst\u00e8me. Cette ordonnance vise notamment \u00e0 permettre aux victimes d\u2019agression sexuelle de participer au processus criminel sans crainte que les m\u00e9dias divulguent leur identit\u00e9.<\/p>\n

Bien que ces ordonnances visent la protection des victimes, le groupe de survivantes My Voice, My Choice a mis en lumi\u00e8re le fait qu\u2019elles peuvent \u00eatre probl\u00e9matiques pour les victimes qui d\u00e9sirent partager leur histoire. Certaines victimes ont m\u00eame subi des mises en accusation pour avoir r\u00e9v\u00e9l\u00e9 leur propre identit\u00e9!<\/p>\n

Pour r\u00e9pondre \u00e0 cette probl\u00e9matique, le gouvernement a pr\u00e9par\u00e9 le projet de loi S-12, qui, entre autres, r\u00e9forme le r\u00e9gime concernant les interdictions de publication. L\u2019objectif \u00e9tait de s\u2019assurer que les victimes\/survivantes soient mieux inform\u00e9es de leurs droits, qu\u2019elles puissent faire retirer une interdiction de publication lorsqu\u2019elles le souhaitent, et qu\u2019elles soient moins \u00e0 risque d\u2019\u00eatre criminalis\u00e9es.<\/p>\n

Lorsque le projet de loi a \u00e9t\u00e9 d\u00e9pos\u00e9 au S\u00e9nat, il est tout de suite devenu apparent que, dans sa premi\u00e8re mouture, il \u00e9chouerait \u00e0 accomplir ces objectifs. C\u2019est pourquoi l\u2019Association nationale Femmes et Droit a travaill\u00e9 de concert avec le gouvernement et d\u2019autres groupes et avocates f\u00e9ministes pour am\u00e9liorer le projet de loi.<\/p>\n

Nous avons particip\u00e9 \u00e0 de nombreuses rencontres avec le gouvernement, soumis un m\u00e9moire d\u00e9taillant les changements \u00e0 apporter au projet de loi, et t\u00e9moign\u00e9 devant le Comit\u00e9 s\u00e9natorial permanent des affaires juridiques et constitutionnelles.<\/p>\n

Nous sommes heureuses de constater que le comit\u00e9 s\u00e9natorial a adopt\u00e9 tous les amendements propos\u00e9s par le gouvernement visant \u00e0 r\u00e9pondre aux probl\u00e8mes que nous avons soulev\u00e9s. Dans sa version actuelle et gr\u00e2ce \u00e0 ces changements, le projet de loi\u00a0:<\/p>\n

    \n
  1. s\u2019assure que les victimes qui enfreignent une interdiction de publication visant leur propre identit\u00e9 ne soient plus criminalis\u00e9es;<\/li>\n
  2. clarifie et simplifie la proc\u00e9dure de r\u00e9vocation ou de modification d\u2019une interdiction de publication;<\/li>\n
  3. garantit un meilleur acc\u00e8s \u00e0 la justice en imposant aux juges et aux procureur\u00b7ses de consulter et d\u2019informer les victimes.<\/li>\n<\/ol>\n

    La prochaine \u00e9tape est l\u2019\u00e9tude et l\u2019adoption du projet de loi par la Chambre des communes, que nous surveillerons cet automne. Nous travaillerons \u00e9galement avec d\u2019autres groupes pour r\u00e9clamer une strat\u00e9gie de communication efficace du gouvernement garantissant qu\u2019une fois le projet de loi adopt\u00e9, les actrice\u00b7teurs du syst\u00e8me judiciaire, incluant les juges, les avocat\u00b7es des victimes et les procureuse\u00b7eurs, seront au courant de ces changements et les mettent en application.<\/p>\n

    Nous f\u00e9licitons le gouvernement pour son ouverture et continuerons \u00e0 engager des dialogues constructifs pour am\u00e9liorer les projets de loi en lien avec les droits des femmes au Canada.<\/p>\n
